Без наследства остался 13-летний воспитанник Мстиславской специализированной общеобразовательной школы-интерната для детей с тяжелыми нарушениями речи: о нем «забыл» дядя и продал дом. Вмешалась прокуратура, сообщается на сайте ведомства.

Прокуратура во время проверки установила, что права 13-летнего мальчика, инвалида 3-й группы и сироты, не соблюдаются. На момент смерти матери мальчик жил и был зарегистрирован в доме его бабушки на улице Л. Чайкиной в Бобруйске. После потери родителей его отправили в спецшколу и там же зарегистрировали.

Потом умерла бабушка ребенка, и дом в Бобруйске в наследство принял дядя мальчика. Причем в заявлении он указал, что других наследников нет. Законный же представитель ребенка, не зная об открытии наследства, не обратился в нотариальную контору.

— Мальчик после смерти матери был наследником умершей бабушки по праву представления. Его доля в наследственном имуществе составляла 50%, — отметили в прокуратуре.

В октябре 2015 года дядя продал дом за 18 тыс. рублей.

Прокуратура в интересах мальчика направила в суд иск с требованиями признать сироту принявшим наследство, выданное его дяде свидетельство о праве на наследство недействительным, а также взыскать с мужчины сумму неосновательно полученного обогащения.

Суд удовлетворил требования прокуратуры и решил, что дядя обязан выплатить мальчику неосновательно полученные 11 604 рубля.

Судебное решение не было обжаловано и вступило в законную силу.
