Подошли к концу судебные слушания по делу о дольщиках с улицы Тельмана, которые остались без квартир и без денег. 9 января в прениях выступили потерпевшие и защитник обвиняемого.
На прошлом заседании прокурор попросил назначить 39-летнему Константину Царькову шесть лет лишения свободы в колонии усиленного режима.
Потерпевшие разделились на два лагеря: одни считают предлагаемый срок слишком мягким, другие, напротив, и вовсе просят оправдать и отпустить обвиняемого. Ведь тогда есть хоть какая-то надежда на то, что он сможет вернуть им деньги. Всего, как говорят сами дольщики, они отдали застройщику 1 млн 560 тысяч долларов. Впрочем, часть денег некоторым из них он все-таки вернул.
— Дадите вы 10−20 лет Царькову. От этого никто в этом зале суда не выиграет. Посадите его хоть на сколько, но мы останемся без денег, — сокрушаются потерпевшие.
Многие винят в сложившейся ситуации местную власть — мол, если бы не создавали предпринимателю излишние запреты и препоны, то дом был бы уже давно построен.
— Деньги у вас брал не горисполком, не облисполком, а Царьков. Вина горисполкома только в том, что не прижали его с самого начала, — считает пенсионер Виктор. Он отдал застройщику более 90 тысяч долларов — мечтал о «двушке» в центре. Он же один из первых и написал на него заявление в милицию.
— Когда я стал подозревать, что дома не будет, то решил забрать деньги. Он мне говорит: «Можете, конечно, забрать, но я вам не советую. Мы заключили договор с китайской компанией. Вы же знаете, как хорошо и быстро строят китайцы? Ваш дом скоро будет построен». И я снова поверил, а когда понял, что уже все, оставалось только писать заявления в милицию и прокуратуру. А когда арестовали имущество, судебные приставы нашли только разломанный табурет, стол, старый компьютер и ершик для унитаза, — рассказывает TUT.BY Виктор.
Алла Ивановна, напротив, считает, что Царьков — жертва обстоятельств. Женщина говорит, что отдала застройщику 189 тысяч долларов, вернул он ей — 34. Если бы не СИЗО, обвиняемый бы давно рассчитался и с ней, и с другими, а может, даже и достроил дом, уверена дольщица.
История с обманутыми дольщиками началась в 2011 году, когда частная компания «ЦентрЛизинг» проанонсировала строительство двух девятиэтажек в Гомеле. Людей предложение заинтересовало — цена новостроек была ниже городской, плюс удачное месторасположение в самом центре города.
Дольщики продавали машины, гаражи, залезали в долги и приобретали жилищные облигации, выпущенные застройщиком. Каждая из облигаций по цене была эквивалентна квадратному метру в планируемой новостройке.
Люди говорят: на тот момент у них не было никаких сомнений, что квартиры они построят без особых проблем. Ведь один из домов к тому времени был уже возведен, а застройщик уверял, что оба дома — цельный проект, следовательно, и волноваться не стоит.
Однако строительство второго дома все откладывалось. Почуяв неладное, дольщики попробовали сдать облигации, но оказалось, что деньги за них вернуть будет непросто. Летом 2017 года предпринимателя задержали.
39-летнего Константина Царькова обвинили в мошенничестве, совершенном в особо крупном размере, а также в хищении путем злоупотребления служебными полномочиями, также совершенном в особо крупном размере.
В суде обвиняемый и его адвокат объясняли, что в процесс строительства вмешивались обстоятельства и различные службы, что повлекло срывы графиков строительства и финансовые потери.
